Ohio

  • First Offense

    Penalties vary depending on the degree of intoxication. For BACs less than 0.17 you could receive the following:

    • For BACs less than 0.17 you could receive a minimum of three days in jail or a mandatory three-day “Drivers Intervention” program
    • For BACs higher than 0.17 you can expect doubled jail time and mandated display of restricted license plates
    • Up to five years of probation
    • Fine ranging from $375 to $1,057
    • Suspension of driver’s license for up to three years
  • Second Offense

    Penalties vary depending on the degree of intoxication.

    • For BACs less than 0.17 you could receive between 10 to 180 days in jail or up to 5 days of jail and 18 days of electronically-monitored house arrest
    • For BACs higher than 0.17 you could receive up to 20 days of jail or 10 days of jail and up to 36 days of electronically-monitored house arrest
    • Fines range between $525 to $1,625
    • Mandatory alcohol/drug assessment with substance abuse treatment
    • Possible interlock device or up to 90-day immobilization of your vehicle
    • Possible license suspension between 1 and 7 years
  • Third Offense

    Penalties vary depending on the degree of intoxication.

    • For BACs less than 0.17 you could receive between 30 days and 1 year in jail or up to 15 days of jail and 55 days of electronically-monitored house arrest
    • For BACs higher than 0.17 you could receive up to 60 days of jail or 30 days of jail and up to 110 days of electronically-monitored house arrest
    • Fines range between $850 to $2,750
    • Mandatory alcohol/drug assessment with substance abuse treatment
    • Possible interlock device, “offender” license plates, and vehicle forfeiture
    • Possible license suspension between 2 and 12 years

Michigan

  • First Offense

    Penalties vary depending on the degree of intoxication.

    • For BACs less than 0.17 you could receive up to 93 days in jail
    • For BACs more than 0.17 you could receive up to 180 days in jail
    • Can receive up to 360 hours of community service
    • Fines can range between $100 and $300
    • Can receive immobilization of vehicle for up to 180 days
    • Can receive license suspension up to 180 days
  • Second Offense

    Penalties vary depending on the degree of intoxication.

    • Can receive between 5 and 360 days in jail
    • Can receive between 30 and 90 days of community service
    • Fines can range between $200 and $1,000
    • Can receive immobilization of vehicle for up to 180 days
    • Can receive license revocation up to 360 days
  • Third Offense

    Penalties vary depending on the degree of intoxication.

    • Can receive between 1 and 5 years in jail.
    • Alternatively, you can receive probation which includes between 30 and 360 days in jail along with 60 to 180 days of community service
    • Fines range between $500 and $5,000
    • Can receive immobilization of vehicle for up to 3 years or a complete vehicle forfeiture
